The pictures of the products on the site do not enter the contractual domain. If errors are found, they are in no way the responsibility of Coliseum.
05. Confirmation of the Order
The customer will receive an acknowledgement by electronic mail citing all the elements of the contract (ordered products, prices, delays in delivery, carriage costs, … )
Coliseum reserves the right to deny confirmation of an order for whatever reason, whether there is a supply problem for the product(s) or a problem regarding the order received.
Offers on this site are valid as long as the products remain on line and are available.
06. Sale Prices
Prices are in Euros. The amounts in dollars, yens or other currencies are only given as a guideline. The exact amount will be determined by the value of the dollar or other currencies at the time of payment.
The guaranteed price is that indicated on the site at the time of purchase.
Delivery cost is added to the price advertised and are indicated on the confirmation of the order.
For a delivery within the European Union prices include VAT.
Neither custom duty nor VAT will be added to the price for a delivery within the European Union. Any change to the applicable rate will be reflected on the sale price of products in the catalogue.
For a delivery outside the European Union, the customer will have to pay custom duties, VAT or other applicable taxes payable for the importation of products in the country of delivery.
Unless stated otherwise, the formalities relating to these operations are to be paid in full by the customer
An invoice will be drawn up by Coliseum. All elements of the address will be detailed by the customer.
Discounts may be available under certain circumstances (holidays, special orders, preferred customers, etc.). In this case a single-use, customer-specific code will be attributed to you. You will be asked to enter this code during confirmation of your cart. Several different discounts are possible:
- On a product
- On a brand
- On a sub-category
- On a category
- On the entire site
- Valid for one person only
- Valid for a limited number of people
- Valid for everyone using the code
- Valid for a limited time
- Valid indefinitely
The conditions of validity will be explained when you receive the discount code.
Discount codes cannot be combined, but they may used with vouchers.
Vouchers are attributed for your referrals. You will find a list of your vouchers along with their validity dates in your customer space.
07. Payment of Purchased Items
Prices must be paid in full at the time of order.
The customer agrees to pay the price stated on the site (price of the product and carriage). The customer also agrees to pay or have paid, whatever the case may be, directly to the carrier, all custom duties, VAT or other taxes as may be applicable in the importation of products in the country of delivery.
The site offers the payment of orders by bank card.
The customer guarantees Coliseum that he/she is authorised to make bank card payments at the time of the order.
08. Failure to pay – Retention of Ownership
The ordered products remain the property of Coliseum until full payment of the prices according to the Law No 80 335 of 12 May 1980. Coliseum retains the right to reclaim the ordered products in the case of non-payment.
If non-payment occurs and upon the first demand by Coliseum, the customer agrees to return all unpaid products, all costs relating to this return being the customer’s responsibility.
The risk in Goods shall pass to the customer upon transfer of the products by Coliseum to the carrier. The products travel at the customer’s own risk. The same applies for products sent postage paid or carriage paid.
During the time of withdrawal (see below: Withdrawal), the customer will guard the product in the legal sense, ensuring its safety.
In case of damage or destruction of the product while in his/her care, the customer will suffer all the consequences.
09. Order Form
The automatic registration systems are considered as proof of the nature, the content and the date of the order. The time of processing the order will be stated on the site and in the confirmation by Coliseum. The processing will take place in a maximum time of 30 days following the confirmation, subject to availability of the products ordered.
Other conditions may be agreed between the parties. Coliseum will have to inform the customer as soon as possible of a discontinuation or unavailability of a product. Coliseum will notify the customer of new delivery conditions and deadlines.
10. Dispatch of Goods
The ordered products which have been confirmed by Coliseum will be delivered at the address stated by the customer on the order form. If the customer wishes several delivery addresses, he/she will have to fill in as many order forms as there are addresses. The product is considered delivered when handed over to the carrier who will ensure the delivery to the customer.
The customer will be considered having received the product in accordance with the order, in perfect condition, at the time of signing the delivery note. He will first check the quality of the product.
The customer will not call Coliseum into question in case of delays, losses or damages after hand-over to the carrier. The customer alone will deal with any claim.
In the case of failure of delivery, Coliseum will not be blamed for causes beyond control. When dispatch is not possible within 3 months, the order will be cancelled by tacit agreement unless mutual agreement has been reached.
11. Complaints
Delivery
All complaints regarding products must be done in writing as soon as delivered and accompanied by the delivery note. Packing must be kept by the customer and be made available to Coliseum or its designated representative.
Order
Should the customer use the withdrawal clause in accordance with the consumer code, he/she must exercise that right within 7 working days after the date of the order and will not be penalised for doing so. The customer will assume, should the product have already been handed over to the carrier, the cost of returning it to Coliseum’s Registered Office in the condition and unopened packaging.
If the packaging has be opened, the product can only be returned in a perfect condition and without having been used at all.
12. Hidden Defects
When products have a longer period of guarantee, the terms of the guarantee are indicated in the document accompanying the products.
13. Legal Information
The personal data collected through distance sales is mandatory; this information is necessary for the processing and dispatching of the orders, the invoicing and guarantee contracts. The lack of information leads to non validation of the order. According to the law regarding “Data Processing and Freedoms” the processing of personal data has been registered with the French “Commission Nationale de l’Informatique et Libertés” (CNIL). According to Article 34 of the Act of 6 January 1978, the customer has the right to access, amend, correct and delete the information concerning him/her, the customer can exercise this right with Coliseum. In addition Coliseum agrees not to communicate, either freely or with gain, any of its customers’ data to a third party.
14. Various Litigations
In cases of litigation, a survey of the electronic files held by Coliseum will be carried out to enable the collation of all essential pieces of evidence.
The present Terms and Conditions of Sale make up the contract and commit both parties unless specific arrangements have been agreed.
Questions regarding the execution of these Terms and Conditions of Sale will be taken, if necessary, to the competent French jurisdictions.
In cases of litigation, the parties declare that competence is ascribed to the tribunals of Department de l’Aveyron, despite plurality of respondents or call in guarantee.
15. Intellectual Property
No-one is authorised to reproduce, exploit, publish on the net, or use for any reason, even partially, elements of the site, be they software, visuals or sound.
